This month, Jeff Pajot will be discussing medical marijuana in the workplace.
Medical Marijuana in the Workplace
Medical Marijuana/Cannabis (MM) is a new and evolving workplace issue. In June 2013, the
Government of Canada implemented the Marijuana for Medical Purposes Regulations
(MMPR). This Regulation authorized physicians to prescribe MM for treatment of conditions
like chronic pain, anxiety, neuropathic pain, epilepsy, spasticity, HIV, MS, cancer drug-induced
nausea, PTSD etc. Only licensed Health Canada approved producers can supply MM/Cannabis.
The implications for the workplace include accommodation for medical disability balanced with
cognitive and physical impairment after a “treatment”. Working with dangerous
equipment/activities (e.g. driving) while impaired, is clearly a major health & safety hazard.
Furthermore, other employees need to be protected from second-hand smoke from MM.
Confidentiality, drug-testing and security issues will also be addressed. Employers need to
educate themselves and staff on this issue and develop health and safety policies for MM, in
conjunction with their Joint Health and Safety Committee.
